These Terms govern your use of the logistics app and services provided by Pichonia LLC (“Pichonia”, “we”, “us”).
Users may be customers, truck owners, or drivers. You must be 18+ and legally able to contract.
Provide accurate information; keep credentials secure; do not misuse the service or violate law. We may suspend/terminate for violations.
Pichonia facilitates connections between parties. We are not the carrier and are not a party to service contracts between customers and owners/drivers.
Charges, fees, and payouts are processed by third-party processors (e.g., Stripe). You authorize us and our processor to charge the payment method you provide. We do not store full card details.
5.1 Cancellations
5.2 Disputes
5.3 Refunds
Note: We can tune the 24h/25%/72h numbers later; these are sane defaults to get stores comfortable.
Owners/drivers are responsible for licenses, insurance, cargo compliance, and safe operation. Hazardous materials or restricted goods are prohibited unless explicitly permitted by law and policy.
You consent to sharing precise location during active jobs (foreground) for routing and proof of service. Background location is used only when a job is active. You can control permissions in device settings; restricting permissions may limit features.
The app, software, and content are owned by Pichonia LLC. You receive a limited, revocable license to use the app subject to these Terms.
Service provided “as is” and “as available.” To the fullest extent permitted by law, Pichonia disclaims warranties and limits liability. In no event shall our aggregate liability exceed the greater of $100 or amounts paid to us by you in the 12 months preceding the claim.
We may suspend or terminate accounts for violations or risk. You may stop using the service at any time; certain obligations (fees owed, disputes) survive termination.
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules.
Binding Arbitration. Except for small-claims matters as noted below, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (or Commercial Rules if you are registering/acting on behalf of a business). The arbitration will be conducted by a single arbitrator. The seat/venue is Delaware, and hearings may be held by video conference unless the arbitrator requires otherwise.
Small-Claims; Injunctive Relief. Either party may bring an individual action in small-claims court with appropriate jurisdiction. Either party may seek temporary or preliminary injunctive relief in a court of competent jurisdiction to protect rights pending arbitration.
Class & Jury Waiver. You and Pichonia agree that each may bring claims only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. You and Pichonia waive any right to a jury trial.
Fees. AAA rules govern fees. Each party bears its own attorneys’ fees and costs unless the arbitrator’s award provides otherwise as permitted by applicable law.
We may update Terms; continued use after changes becomes effective constitutes acceptance of the updated Terms.
